1. Acceptance of Terms

By purchasing, accessing, or using The Ultimate Screenwriter course ("Course"), you ("Student," "Purchaser," "Buyer," "Recipient," "Submitter," "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not purchase or access the Course.

These Terms constitute a binding legal agreement between you, the buyer or recipient of the Course, student of this Course, submitter, and Waking Life Films Inc., The Ultimate Screenwriter, and all subsidiaries ("Company," "we," "us," "our"). By purchasing, receiving, accessing, studying, or submitting work under this Course, you are legally bound by all Terms and Conditions herein.

2. Course Access and Content

2.1 License Grant

Upon purchase, you receive a non-exclusive, non-transferable, revocable license to access the Course content for personal, non-commercial use only.

2.2 Course Completion Requirement

You must complete 100% of the Course lessons before becoming eligible for the Producer Read Guarantee. We track course completion. Incomplete courses are ineligible.

2.3 No Refunds

ALL SALES ARE FINAL. Due to the immediate access to digital content and the guaranteed producer read offer, no refunds will be issued once purchase is complete, regardless of whether you complete the course, submit your screenplay pages, or receive feedback.

3. Producer Read Guarantee – Terms and Conditions

3.1 Eligibility Requirements

To be eligible for the Producer Read Guarantee, you MUST:

  • Purchase The Ultimate Screenwriter Course in your own name and provide proof of purchase upon request
  • Complete 100% of all course lessons
  • Write and submit your original screenplay
  • Submit your original screenplay within 365 calendar days from your date of purchase
  • Submit via email to admin@theultimatescreenwriter.com with your purchase receipt number and a brief logline
  • Ensure your submission meets the formatting and quality standards outlined in Section 3.6

CRITICAL FRAUD WARNING:

  • You MUST be the actual purchaser of the Course to be eligible
  • Proof of purchase must match YOUR identity and payment information
  • Submitting under someone else's account or using someone else's purchase is FRAUD
  • Fraudulent submissions will result in immediate disqualification, legal action, and potential criminal prosecution
  • We reserve the right to verify your identity and require government-issued ID or other documentation at any time
  • See Section 10.9 for complete fraud liability and consequences

3.2 One-Year Eligibility Window

The Producer Read Guarantee expires exactly 365 days after your purchase date. If you do not submit your ten pages within this timeframe, you forfeit your eligibility. To regain eligibility, you must repurchase the Course at the current price, and the offer must still be active at the time of repurchase.

3.3 Producer Selection

Producer selection is at the sole and absolute discretion of The Ultimate Screenwriter team. You do not have the right to request a specific producer, suggest producers, demand alternatives, reject the assigned producer, or receive information about the producer's identity before your submission is read. By submitting your pages, you accept that the assigned producer is final and non-negotiable.

3.4 Scope of Producer Read

The assigned producer is guaranteed to read ONLY the first ten (10) pages of your submitted screenplay. If your script captivates the producer, he may of his own accord, read more than ten (10 pages) of your submitted screenplay. They will provide WRITTEN notes/feedback ONLY on those ten pages within 45 days of submission.

CRITICAL: THIS OFFER INCLUDES WRITTEN FEEDBACK ONLY. We do not guarantee phone calls, video calls, in-person meetings, ongoing dialogue, responses to follow-up questions, or any form of communication beyond the written notes provided.

3.4A Buyer's Responsibility to Protect Their Own Work

YOU ARE SOLELY AND COMPLETELY RESPONSIBLE FOR PROTECTING YOUR SCREENPLAY AND ALL ASSOCIATED INTELLECTUAL PROPERTY.

Required actions include Copyright Registration with the U.S. Copyright Office, WGA Registration, and maintaining legal documentation such as dated drafts and Creative process records. You are responsible for negotiating your own NDAs and securing professional representation like an entertainment attorney.

3.5 Three-Strike Policy

If your submission does not meet professional standards, we reserve the right to invoke the "Three-Strike Policy." After the first and second submissions, you may resubmit revised pages based on feedback. If the third submission still fails to meet standards, you will be required to take a mandatory 90-day break before submitting again.

3.6 Submission Standards

Your submission must be ten (10) pages only, properly formatted (Courier 12pt font, industry standard format), be your original work in English, include a brief logline, and be submitted as a PDF file. Submissions failing these requirements may be rejected without feedback.

4. No Guarantees of Commercial Success

This Course is for educational purposes. We make NO guarantees, representations, or warranties regarding the sale, production, representation, or financial success of your screenplay or career. Producer feedback is final, and producers are under no obligation to engage with you beyond the initial ten-page read.

5. Intellectual Property Rights

All Course content is the exclusive property of The Ultimate Screenwriter and Ron Osborn. You may not record, reproduce, or distribute the materials. You retain all intellectual property rights to your screenplay, granting us only a limited license to evaluate it for the purpose of the Producer Read Guarantee.

6. Limitation of Liability

To the fullest extent permitted by law, the Company's total liability shall not exceed the amount you paid for the Course. We are not liable for lost profits, emotional distress, or consequential damages. The Course and Guarantee are provided on an "As-Is" basis.

7. Modification and Termination

Waking Life Films Inc. reserves the right to modify, suspend, or terminate the Producer Read Guarantee at any time. Changes to Course content, pricing, or terms will be posted on our website and continued use constitutes acceptance.

8. User Conduct

You agree not to harass or abuse the team, make defamatory statements, demand preferential treatment, or submit plagiarized content. Violations may result in immediate termination of access without refund.

9. Indemnification

You agree to indemnify and hold harmless Waking Life Films Inc. and associated parties from any claims, damages, or expenses arising from your breach of terms, your screenplay content, or any fraud you commit.

10. Screenplay Outcomes and Strict Indemnification

You expressly agree to hold all Released Parties completely harmless from all successful, unsuccessful, or neutral outcomes related to your screenplay. You assume 100% responsibility for plagiarism, copyright infringement, and legal claims arising from your content.

10.6 Plagiarism Definition

Plagiarism includes direct copying, patchwriting, character theft, and appropriation of story concepts. You acknowledge that ignorance or "unintentional" copying does not excuse liability. Detection of fraud or plagiarism results in a permanent ban and potential legal action.

10.7 Indemnification If Sued

If any industry entity sues you regarding your screenplay, you will indemnify and defend the Released Parties 100%. You must notify us within 48 hours of any legal demand and hire your own counsel at your expense.

10.9 Fraud and Identity Misrepresentation

Submitting work under another person's name or falsifying purchase information is fraud. This is a crime we will prosecute to the fullest extent of the law, including pursuing criminal charges and civil damages.

11. Right to Terminate Offer

The Company reserves the absolute right to discontinue the Producer Read Guarantee at any time, even for students within their 365-day window, without entitlement to refunds or compensation.

13. Dispute Resolution

These Terms are governed by the laws of Tennessee. Any disputes shall be resolved through binding arbitration in Nashville, TN. You waive your right to a jury trial or class action.
